Which is morefully described in the Schedule [Herein after referred as <b>“Schedule Property”</b>].</p> <h2 class="title-head">Title in respect of land bearing Survey No 256/3 (Old No, 256/1):-</h2> <p>WHEREAS, originally the land bearing Survey No. 256/1, measuring 2 Acres 21 guntas, situated at Bogadi Village, KasabaHobli, Mysore Taluk was belonged to one Sri Dyavaiah S/o Somaiah. After the Death of Sri Dyavaiah, the Khata of the said land was mutated in the name of his children Sri DoddaMadaiah and Sri ChikkaMadaiah, through Mutation Proceedings bearing IHR No. 7/96-97. Later on, the said Sri DoddaMadaiah, Sri ChikkaMadaiah and Sri Madaiah S/o Basavaiah i.e., son of Smt. Madi D/o Dyavaiah divided the said lands. In pursuance of the said division, the Land bearing Survry No. 256/1, measuring 2 acte 21 guntas was mutated in the name of Sri Madaiah S/o Basavaiah through Mutation Proceedings bearing IHR No. 14/1996-97.</p> <p>WHEREAS, the Sri K.V.R. Prasad purchased the said land bearing Survey No. 256/1, measuring 2 acre 21 guntas from Sri Madaiah S/o Basavaiah, his wife SmtMahadevamma and their children namely SmtShivamma, Sri Nagaraju, Sri B.M.Basavaraju, SmtSaroja, SmtShanta, SmtBasammanni W/o Sri Nagaraju and SmtRagini W/o Sri B.M.Basavaraju through Registered Sale Deed bearing Document No: MYN-1-03575-2005-06, stored in CD No. MYND: 89 of book I, registered before the Sub-Registrar, Mysore-North, Mysore on 06/05/2006. In pursuance of the said Sale Deed, the Khata of the said land was mutated in the name of Sri K.V.R Prasad through Mutation Proceedings bearing M.R.No. 211/2005-06. In a podi proceedings, new sub number is assigned in respect of land bearing Survey.No.256/1 measuring 1 Acre 12 Guntas as Survey 256/3.</p> <p> WHEREAS, Sri K.V.R.Prasad after receiving the entire sale consideration amount in full and final settlement without further assurance and acknowledging the payment sold above said land bearing Survey.No.256/3 measuring 1 Acre 12 Guntas in favour of Sri M.K.Shashikanth on 29/03/2019 through registered sale deed bearing document No.MYN-1-09624-2018-19, stored in C.D.No.MYND-487 of Book I, registered in the office of Sub-Registrar Mysore North. After purchase, Sri M.K.Shashikanth transferred the Khata of said land to his name in the revenue records under M.R.No.H109/2018-19.</p> <h2 class="title-head2">Title in respect of land bearing Survey No 256/4 (Old No, 256/2):-</h2> <p>WHEREAS, originally land bearing Survey.No.256/2 measuring 3 Acres 7 Guntas situated at Bogadi Village, KasabaHobli, MysoreTaluk was belonging to SriDyavarasegowda as per the Khethuvaru extract issued by Tahasildar, Mysore Taluk. After the death of Dyavarasegowda, his son SriChikka Madaiah alias Puttaiah inherited the above land.</p> <p>WHEREAS,SriChikkaMadaiah alias Puttaiah and his minor children namely Sri Mahadevaiah and Sri Basavaiah represented by their guardian fatherSri ChikkaMadaiah alias Sri Puttaiah jointly sold above said land in favour of SriEregowdaS/o Channegowdaon29/10/1965, through registered sale deed bearing No.2074,in Vol-251 of book 1 registered before the Sub-Registrar Mysore.In pursuance of the sale deed Sir Eregowda got the Katha transferred to his name in the revenue records underM.R.No.30/1987-88.</p> <p>WHEREAS,Sri Eregowdadied intestate leaving behind his children namelySmtNingamma,SmtPuttathyammaandSri Puttaswamyas legal heirs. After the death of Sri Eregowda, his sonSri Puttaswamytransferred above said land to his name in the Revenue records under M.R.No.59/1987-88.</p> <p>WHEREAS, Legal heirs of Late Eregowda namely SmtNingamma, SmtPuttathayamma and Sri Puttaswamy and SmtMahadevammaW/o Sri Puttaswamy, her children namelySri Swamy,Sri Eshwar, Sri Ramalinga, SmtMahalakshmiandSmtSavithriW/oSwamy,SmtJayalakshmiW/oEshwarand SmtRekhaW/o Ramalingajointly sold above said land in favour of Sri K.V.R.Prasadon07/04/2006 through a registered sale deed bearing documentNo.MYN-1-00638-2006-07, stored in C.D.No.MYND-84 of Book-1 registered in the office of Sub-Registrar Mysore North, Mysore. In pursuance of the above said sale deedSri.K.V.R.Prasad got the Katha transferred in his name in the revenue records under M.R.No.193/20052006. In a podi proceedings new sub number assigned in respect of land bearing Survey No.256/2 measuring 38 Guntas as256/4.</p> <p>WHEREAS,Sri.K.V.R.Prasadafter receiving the entire sale consideration amount in full and final settlement without further assurance and acknowledging the payment has sold the above said land bearing Survey. No.256/4 measuring 38 Guntas in favour ofSri M.K.Shashikanththrough a registered sale deed bearing document No.MYN-1-09621-2018-19, stored in C.D.No.MYND-487 of Book I registered in the office of Sub Registrar Mysore North, Mysore on29/03/2019. In pursuance of the above said sale deedSriM.K.Shashikanthgot the kathatransferred in his name in the revenue records underM.R.No.H110/2018-19.</p> <p>WHEREAS,Sri M.K.Shashikanthbecame absolute owner of land bearingSurvey.No.256/3 measuring 1 Acre 12 Guntas and land bearingSurvey.No.256/4 measuring 38 Guntas totally measuring 2 Acres 10 Guntas.</p> <p>WHEREAS,Sri M.K.Shashikanthobtained the conversion order in respect of the above said lands i.e., land bearingSurvey.No.256/3 measuring 1 Acre 12 Guntas for residential purpose by from Deputy Commissioner, Mysore District, Mysore on06/11/2019under order bearing No.DMD3980349818F3D. SimilarlySri.M.K.Shashikanthobtained the conversion order in respect of the above said lands i.e., land bearingSurvey.No.256/4 measuring 38Guntas for residential purpose by from Deputy Commissioner, Mysore District, Mysore on06/11/2019under order bearing No.DMD39803497741FD.</p> <p>WHEREAS,SriM.K.Shashikanthis in possession and enjoyment of undeveloped alienated land bearingSurvey.No.256/3 measuring 1 Acre 12 Guntas and land bearingSurvey.No.256/4 measuring 38 Guntas totally measuring 2 Acres 10 Guntas as absolute owner. </p> <h2 class="title-head3">Title in respect of land bearing Survey No. 257/3:-</h2> <p>WHEREAS, originally land bearingSurvey.No.257/1 measuring 1 Acre situated at Bogadi Village, KasabaHobii, MysoreTaluk was belonging to one Sri.Doddamadaiah S/o Devaiah. SriDoddamadaiahacquired the said property from their ancestors and the physical possession of the property along with entries in the revenue records and Sri Doddamadaiah along with his wifeSmtMaramma and their children namelySri M.D.Nagaraju, his wife SmtRevamma and Sri M.ShivanandaS/o SriDoddamadaiah, hiswifeSmtGowramma, SriM.ManjunathaSwamyS/o SriDoddamadaiah, his wife SmtPreethiand daughters of SriDoddamadaiah namely SmtJayamma andSmt.Bhagya have jointly sold the above said land in favour of Sri Bhawarlal on24/08/2006 through a registered Sale deed bearing document No. MYN-1-15636-2006-07, stored in C.D.No.MYND-109 of Book 1, registered in the office of Sub-Registrar Mysore North Mysore on 24/08/2006, in pursuance of the above sale deedSri Bhawarlal got the katha transferred in his name in the revenue records as per MR No.28/2007-08. In a Podi proceedings, new sub number assigned in respect of land bearingSurvey.No.257/1 <span class="measuring">measuring 1 Acre as257/3.</span></p> <p>WHEREAS,SriBhawarlalobtained the Conversion order from Deputy Commissioner, Mysore District, Mysore on13/02/2020 vide orderNo.140786 in respect of the land bearingSurvey.No.257/3 measuring 1 Acre for residential purpose.</p> <p>WHEREAS, the Vendors i.e.,Sri Jayaramu and Sri Ravi.R purchased the above converted lands from its owners in the following manner </p> <p>1.1. Registered sale deed bearing Document No. MYN-1-01003-2020-21,stored in CD No. MYND769 of Book 1 registered before the Sub registrar, Mysore North, Mysore on 26/06/2020 in respect of converted land bearing Survey No.256/3(old Survey No.256/1) measuring 1 acre 12 guntas and land bearing Survey No.256/4(Old No.256/2) measuring 38 guntas from Sri.M.K.Shashikantha.</p> <p>2.2. Registered sale deed bearing Document No. MYN-1-01002-2020-21,stored in CD No. MYND769 of Book 1 registered before the Sub registrar, Mysore North, Mysore on 26/06/2020 in respect of converted land bearing Survey No.257/3measuring 1 acre from Sri.Bhawarlal </p> <p>Whereas, the Vendors have executed a Registered Deed of Relinquishment dated 21/01/2021 in favour of the Governor of Karnataka represented by the Commissioner, MUDA, Mysore, with respect to the roads, parks and civil amenity sites and the same is registered as document No. MDA-1-01168-2020-21, in stored CD No. MDAD-505 of Book I before the Additional District Registrar, Mysore on28/01/2021. </p> <p>Thereafter, the Vendors have applied for the sanction of layout plan before the Mysore Urban Development Authority, Mysore <b>(“MUDA”)</b> and obtained the Preliminary Layout Plan sanction vides No. MYNAPRA/NAYO/VINA/76/2020-21 dated 02/03/2021 for formation of a residential layout in the above said property comprising 72 residential plots. As per the scheme of development and the sanctioned layout plan, the said landed Property is earmarked for the purpose of formation of residential layout with residential sites comprising various sizes with parks, roads and other basic civic amenities. The said residential layout is named as <b>‘MMG GREEN CITY’</b> (<b>“Project”</b>) by the Vendors.</p> <p>Whereas, The Vendors in pursuance of the layout plan sanction and the Commencement Certificate being granted by MUDA to develop the project vide approval dated 22/04/2021 bearing work order no. MY NA PRA /PB/ KHABA/ 1604/2021-22 has commenced and completed substantial portion of the development work of the residential layout namely <b>“MMG GREEN CITY”</b> as per the norms of MUDA, Mysuru and conditions stipulated in the layout plan sanction. </p> <p>The Purchaser herein after being fully satisfied with the title of the Vendor over the above said land and various sanctions and approvals secured by the Vendors for the formation of the residential layout have offered to purchase the <b>residential plot bearing No.05</b> in <b>“MMG GREENCITY”</b> which is more fully described in the Schedule and hereinafter referred to as <b>“SCHEDULE PROPERTY”</b> for a valuable sale consideration of <b>Rs.<?php echo $details->sale_price;?> /- (Rupees Thirty Three Lakhs Only)</b> and the Vendors have accepted the offer of the Purchaser and agreed to sell the Schedule Property to the purchaser. </p> <h2 class="agmt-sales">NOW THIS AGREEMENT OF SALE WITNESSES AND THE PARTIES HEREIN HAVE AGREED WITH EACH OTHER AS HERE UNDER.</h2> <p>That in pursuance of the aforesaid Agreement and in consideration of the mutual obligations undertaken by the parties hereto, the SELLER shall sell and the PURCHASER shall purchase the Schedule Property free from all encumbrances, mortgages, litigations, maintenance charges, claims and demands, court attachments, acquisition proceedings, departmental and governmental proceedings etc., subject to the following terms and conditions:- </p> <ul class="sale-list"> <li><b class="price">SALE PRICE:</b> The Sale Consideration of the Schedule Property Payable by the PURCHASER to the SELLER shall be <b>Rs.<?php echo $details->sale_price;?>/- (<strong class="sale_price_words"></strong>)</b> The sale price stipulated above is for sale of the site measuring as detailed in the schedule of the property</li> <li><b class="advance">ADVANCE AMOUNT:</b> The SELLER herein acknowledges to have received a sum of <b>Rs. <?php echo $details->advanced_amount;?>/- (<strong class="advanced_amount_words"></strong>)</b> as Advance Sale Consideration from the PURCHASER.</li> <li><b class="Balance">BALANCE SALE CONSIDERATION:</b> The Balance Sale Consideration of <b><?php echo $details->balance;?>/- (<strong class="balance_words"></strong>)</b> shall be paid by the PURCHASER to the SELLER on or before the date of Registration of the Absolute Sale Agreement before the jurisdictional Sub-registrar.</li> <li>The sale transaction shall be completed within 45 days from date of obtaining Release order and Katha. Time being the essence of this contract.</li> <li>The VENDORS shall execute and registered a proper conveyance in respect of the schedule property in favour of the PURCHASER provided that all the terms and conditions herein to be observed and performed shall have been duly performed and observed before the VENDORS if required to execute conveyance in favour of the PURCHASER.</li> <li>The VENDORS have agreed to hand over the vacant possession of the schedule property and available Xerox and Original documents pertaining to the schedule property at the time of the registration of regular sale deed in favour of the PURCHASER.</li> <li>The stamp duty and the registration charges and other expenses for the conveyance shall be borne by the PURCHASER.</li> <li>If the VENDORS fails to execute and register the proposed sale deed within the stipulated period as stated above, the PURCHASER has the right to claim specific performance of contract in respect of the above said sale transaction as contemplated under law.</li> <li>If the PURCHASER fails to get the execution of Registration of sale deed within the time stipulated, the VENDORS have right to claim the damages as per law from the PURCHASER.</li> <li>The VENDORS hereby agrees and undertake to indemnify and keep indemnified the PURCHASER against all cost, damages, charges that may be suffered or incurred by the PURCHASER as a result of any defect in the title in respect of the schedule property or any breach of the covenants contained herein.</li> </ul> </div> </section> <section class="schedule"> <div class="container"> <h2 class="schedule-head">SCHEDULE</h2> <p>All that piece and parcel of the Residential <b>Site bearing No. <?php echo $details->site_no;?>,</b> measuring <b>East - West :<?php echo $details->east_west;?> Meters</b> and <b>North - South :<?php echo $details->north_south;?></b> Meters in all measuring <b><?php echo $details->sq_mt;?> Sq.
