Jayaramu purchased the undeveloped converted landed property situated at Kuppedada Village, BelagolaHobli, SrirangapatnaTaluk, Mandya District,</p> <p>consisting of -Sy No. 15/1 measuring 05 Acres 19 guntas, Sy No. 16 measuring 02 Acres 09 guntas, Sy No. 19 measuring 05 Acres 14 guntas, Sy No. 20 measuring 02 Acres 37 guntas, Sy No. 39 measuring 19 guntas, Sy No. 40 measuring 01 Acre 09 guntas (including 03 guntas of ‘A’ Kharab) and Sy No. 41 measuring 20 guntas (including 1 gunta of ‘A’ Kharab) in all totally measuring 18 Acres 07 guntas situated at Kuppedada Village, BelagolaHobli, SrirangapatnaTaluk, Mandya District vide a registered Deed of Absolute Sale registered as No:SRP-1-01101-2018-19, Book-1, Stored in CD No. SRPD-138,registered on 26/05/2018 in the Office of the Sub-Registrar, Srirangapatna. (Converted vide order of Deputy Commissioner, Mandya District, Mandya, dated 04.11.2016, bearing No. ALN(2)MISC-60/2015-16)-from his Vendor,M/s. R.R. Developers, The Partnership firm came to be reconstituted vide Deed of Reconstitution dated 07.02.2018, registered as document No.SRP-1-06963-2017-18, Book-1, stored in C.D.No.SRPD134, in the office of the Sub-Registrar, Srirangapatna.</p> <p>WHEREAS,certain errors in the schedule to the Sale Deed dated 25-09-2017, executed by M/s. Chemicarb Private Limited in favour of M/s. R.R Developers, had inadvertently crept in, the said errors were rectified under the Deed of Rectification dated 17-09-2018, registered as document No.SPR-1-03676-2018-19, Book-1, Stored in CD No. SRPD142, in the Office of the Sub-Registrar, Srirangapatna and simultaneously similar errors in the Sale Deed dated 24/05/2018 executed by M/s. R.R Developers in favor of the Seller were rectified under the Deed of Rectification dated 17-09-2018, registered as document No.SPR-1-03679-2018-19, Book-1, Stored in CD No. SRPD142, in the Office of the Sub-Registrar, Srirangapatna.</p> <p>WHEREAS, the SELLERthereafter with an intention of forming a residential layout in the name and style <b>‘MMG Grand CITY’</b> sought for Layout Plan approval from the Mysore Urban Development Authority (MUDA) and was advised by the MUDA to deposit the requisite fee for the same. As per the directions of MUDA the SELLER herein has remitted the requisite fee. Now the </p> <p>SELLER completed the development of the layout as per the approved plan by adhering to the conditions, rules & regulations of the Mysore Development Authority and other concerned Authorities as applicable. </p> <p>WHEREAS, the SELLERobtained the Preliminary Layout Plan sanction vide No.MAINAPRA/NAYO/VINA/16/2019-20 for formation of a residential layout in the </p> <p>Schedule property comprising of 305 residential plots.Thereafter Commencement certificate being granted by MUDA to develop the project vide approval dated 06/12/2019 bearing registration No.MAINAPRA/PB/KHABA/1424/2019-20 has commenced and completed substantial portion of the development work of the residential layout namely <b>“MMG GRAND CITY”</b> as per the norms of MUDA and conditions stipulated in the layout plan sanction, subsequent to which, MUDA has issued the Final </p> <p>Layout Plan and the Release Order dated: 30.12.2020 bearing No.MYNAPRA:NAYOSHA:ANTHIMAANUMODANE:45/2020/21, thus releasing all the sites in the residential layout for sale, in recognition of completion of the development work in the layout.</p> <p>WHEREAS the SELLER is having complete ownership and absolute right over the Schedule Property and is free to deal with the Schedule Property as per his will and wish, and has offered tosell the Schedule Property to the PURCHASER for a consideration free from all encumbrances and the PURCHASER has agreed to purchase the Schedule Property free from all encumbrances.</p> <p>WHEREAS, now the parties decided to record all the terms and conditions and payments schedule as herein. </p> <p><b>NOW IT IS HERE BY AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: </b></p> <p>That in pursuance of the aforesaid Agreement and in consideration of the mutual obligations undertaken by the parties hereto, the SELLER shall sell and the PURCHASER shall purchase the Schedule Property free from all encumbrances, mortgages, litigations, maintenance charges, claims and demands, court attachments, acquisition proceedings, departmental and governmental proceedings etc., subject to the following terms and conditions:- </p> <ul class="agreed_parties"> <li><b class="sale">SALE PRICE:</b> The Sale Consideration of the Schedule Property Payable by the PURCHASER to the SELLER shall be <b>Rs.<?php echo $details->sale_price;?>/- (<strong class="sale_price_words"></strong>)</b>The sale price stipulated above is for sale of the site measuring as detailed in the schedule of the property</li> <li><b class="amount">ADVANCE AMOUNT:</b> TheSELLER herein acknowledges to have received a sum of <b>Rs. <?php echo $details->advanced_amount;?>/- (<strong class="advanced_amount_words"></strong>)</b> as Advance Sale Consideration from the PURCHASER.</li> <li><b class="balance">BALANCE SALE CONSIDERATION:</b> The Balance Sale Consideration of <b><?php echo $details->balance;?>/- (<strong class="balance_words"></strong>)</b> shall be paid by the PURCHASER to the SELLER on or before the date of Registration of the Absolute Sale Agreement before the jurisdictional Sub-registrar.</li> <li><b class="period">PERIOD FOR COMPLETION:</b>Time is the essence of this agreement and the period for the completion of this sale transaction and registration of the Sale Deed shall be completed within 30 days from the date of SELLER obtaining the Correct Dimension Report (CDR) from the concerned authority.</li> <li><b class="title">TIITLE DEEDS:</b>The SELLER has this day given the Photocopies of the documents concerned to the Schedule Property and shall deliver those original documents pertaining to the Schedule Property to the PURCHASER on the date of execution and registration of the Absolute Sale Deed in favour of the PURCHASER conveying the Schedule Property on receiving the the entire Sale Consideration amount from the PURCHASER.</li> <li><b class="possession">POSSESSION:</b>The SELLER shall deliver and put the PURCHASER in actual physical vacant possession of Schedule Property after the execution of Sale Deed against payment of balance sale consideration.</li> <li><b class="nomine">NOMINATION:</b> The SELLER hereby agreed to register the sale deed in Favour of the PURCHASER or his Nominee/s as required by the PURCHASER under the same terms and conditions contained herein.</li> <li><b class="expense">EXPENSES:</b>The PURCHASER shall bear and pay the cost of non-judicial stamp papers, registration fee and other expenses for registration of the Sale Deed. Both the Parties have agreed to pay their respective legal counsel’s fee.</li> <li><b class="identity">INDEMNITY:</b> The SELLER hereby undertake to and do indemnify the PURCHASER against all loss or any claims, disputes, proceedings, actions, demands whatsoever in respect of the right and title relating to the Schedule Property up to the point of conveying the right & title to the PURCHASER.</li> <li><b class="breach">BREACH OF COVENANTS:</b> In the event of the PURCHASER failing to pay the balance Sale Consideration to the SELLER and get the Schedule Property registered within the period as agreed herein the SELLER is at liberty to deal with the Schedule Property according to his liking by repaying the Advance Sale Consideration to the PURCHASER. </li> </ul> <p>Either party is at liberty to enforce this Agreement by invoking specific performance clause available under the law of land in the event of breach of the terms of this agreement by the other party.</p> </div> </section> <section class="sechudle_property"> <div class="container"> <h2 class="schedule-head">SCHEDULE PROPERTY</h2> <p>All that piece and parcel of portion of property bearing vacant Site No:<b><?php echo $details->site_no;
